MADE-TO-ORDER POLICY

This Made-to-Order Policy governs made-to-order, pre-order, allocation-based, specially sourced, limited-run and production-linked Products offered by KANG SEORYUN™ at kangseoryun.com.

This Policy should be read together with our Terms of Sale & Use, Shipping & Delivery Policy, Returns & Exchanges Policy, Warranty, Defects & Claims Policy, Credits & Vouchers Terms and any product-specific notices published on the Website.

1. Application and Scope

1.1 This Policy applies to any Product identified on the Website or at checkout as made-to-order, pre-order, allocation-based, specially sourced, limited-run, production-linked or otherwise subject to delayed or staged fulfilment.

1.2 This Policy applies in addition to our Terms of Sale & Use. If a product-specific notice, written confirmation or separate written agreement states otherwise, that more specific term will prevail to the extent of any inconsistency.

1.3 This Policy may apply to Physical Products, Digital Products or hybrid product arrangements where production, allocation, release staging, customization, sourcing or fulfilment does not occur immediately upon Order placement.

2. Nature of Made-to-Order Products

2.1 A made-to-order or production-linked Product is not treated in the same way as an in-stock Product. Such Products may be manufactured, assembled, sourced, customized, prepared, released or allocated only after an Order is placed or after a defined production window, release cycle or allocation event.

2.2 By placing an Order for such a Product, you acknowledge that fulfilment may depend on one or more variable factors including production lead time, material availability, supplier coordination, manufacturing capacity, quality review, rights clearance, batch scheduling, release staging, transit conditions or customs processes.

2.3 Product visuals, mock-ups, renders, sample images, campaign imagery, prototype references, editorial styling or release graphics are intended to communicate the general identity and expected presentation of the Product. Minor non-material differences in packaging, finish, hardware, texture, color tone, trim, detailing, formatting, file structure or release sequence may occur.

3. Order Acceptance and Production Commencement

3.1 Submission of an Order for a made-to-order or production-linked Product constitutes a request to purchase; it does not, by itself, guarantee final acceptance, immediate production or fixed allocation.

3.2 We may accept, reject, limit, delay, suspend or cancel any such Order where necessary for stock control, production control, supplier limitations, verification, risk review, pricing correction, product changes, rights issues, operational feasibility or legal compliance.

3.3 Production, sourcing, customization, release preparation or allocation may begin only after payment authorization, internal review and any required operational or verification steps have been completed.

4. Estimated Timelines

4.1 Any timeline stated for a made-to-order or production-linked Product is an estimate unless expressly identified by us in writing as a guaranteed deadline.

4.2 Estimated timelines may be stated on the product page, at checkout, in an order confirmation or in another transaction-related communication.

4.3 Estimated timelines may change due to production delays, sourcing delays, supplier adjustments, material shortages, transit issues, customs processes, operational load, quality-control review, force majeure events or other circumstances outside our reasonable control.

4.4 Delay in fulfilment, by itself, does not automatically entitle you to cancellation, refund, compensation or chargeback unless required by applicable law or expressly approved by us in writing.

4.5 For certain made-to-order Physical Products, please allow up to 25 - 30 business days from the date of order for production and fulfilment, including delivery transit time, unless a different timeline is stated on the product page or at checkout.

5. Product Availability and Allocation

5.1 Certain made-to-order or production-linked Products may be offered subject to batch limits, quota limits, allocation limits, release windows or production capacity.

5.2 We reserve the right to limit quantities, decline bulk orders, refuse duplicate transactions, restrict orders by territory or otherwise manage availability in the manner we consider appropriate for the relevant Product.

5.3 If demand exceeds available production or allocation capacity, we may, at our discretion:

  • fulfil Orders in sequence;
  • defer fulfilment to a later batch or release cycle;
  • offer a revised fulfilment timeline;
  • offer store credit;
  • offer a refund;
  • cancel the affected Order in whole or in part.
6. Changes, Amendments and Cancellations

6.1 Once an Order for a made-to-order or production-linked Product has been accepted, changes may be restricted or unavailable.

6.2 No change of size, color, specification, quantity, customization detail, recipient information or shipping instruction is guaranteed after Order submission, particularly where production, sourcing, allocation, packaging or release preparation has already commenced.

6.3 Cancellation requests are assessed at our discretion and may be refused where the Product has entered production, sourcing, customization, release preparation, allocation, packing or dispatch planning.

6.4 Where cancellation is exceptionally approved after costs have already been incurred, we may deduct reasonable non-recoverable costs, production costs, sourcing costs, allocation costs, payment-processing costs or other direct costs to the extent permitted by applicable law.

6.5 Products marked as final sale, non-cancellable, custom-made, personalized, specially sourced or limited allocation may not be cancelled after Order placement unless required by applicable law or expressly approved by us in writing.

7. Pricing and Payment

7.1 Unless expressly stated otherwise, full payment may be required at the time the Order is placed.

7.2 In some cases, we may permit staged payment, deposits, reservation fees, balance payments or other payment structures. Any such arrangement will be governed by the product page, checkout terms or written confirmation applicable to the relevant Product.

7.3 Where a deposit or staged payment arrangement applies, failure to complete payment by the required deadline may result in cancellation of the Order, forfeiture of the reservation, loss of production priority or application of other stated consequences, subject to applicable law.

7.4 Prices for made-to-order or production-linked Products may reflect the nature of the production model, sourcing method, allocation structure, customization level or limited availability of the Product.

8. Customization and Special Instructions

8.1 If a made-to-order Product permits customization, personalization or specification requests, you are responsible for reviewing and confirming the accuracy of all submitted details before completing the Order.

8.2 We are not responsible for errors arising from incorrect, incomplete or unclear customization instructions supplied by you.

8.3 Once accepted, customization details may not be changed.

8.4 Custom, personalized or specification-based Products may not be cancelled, returned or exchanged except where the Product is materially defective, materially different from what was agreed or otherwise subject to a non-excludable legal remedy.

9. Packaging, Components and Non-Material Variations

9.1 We reserve the right to make minor non-material changes to packaging, inserts, protective materials, presentation elements, supporting components, hardware, finishing methods, sourcing origin or equivalent non-essential details where reasonably necessary for production, supply continuity, safety, compliance, fulfilment or operational efficiency.

9.2 Such changes do not constitute a material defect, a materially different Product or a basis for return, refund or cancellation where the core identity, intended function and substantial commercial character of the Product remain consistent.

10. Delays, Suspension and Inability to Fulfil

10.1 We may delay, suspend or cancel fulfilment where necessary due to material shortages, production interruption, supplier failure, manufacturing issues, customs issues, transport interruption, legal restrictions, compliance concerns, force majeure events, rights issues or other circumstances materially affecting performance.

10.2 If fulfilment becomes impossible, commercially impracticable or materially compromised, we may, at our discretion and subject to applicable law:

  • offer a revised timeline;
  • offer a comparable replacement;
  • offer store credit;
  • issue a full or partial refund;
  • cancel the affected Order.

10.3 We are not liable for delay, postponement or non-performance caused by matters outside our reasonable control, subject always to any non-excludable rights under applicable law.

11. Shipping and Delivery

11.1 Shipping, dispatch, transit, customs handling, delivery estimates, risk allocation and related fulfilment matters for Physical Products are governed by our Shipping & Delivery Policy.

11.2 A made-to-order or production-linked Product may be shipped from a different fulfilment point, warehouse, supplier location or production source than an in-stock Product.

11.3 Orders containing made-to-order Products and in-stock Products may be held, split or separately dispatched at our discretion.

11.4 Shipping timelines do not begin when the Order is placed; they begin when the relevant Product is ready for dispatch unless expressly stated otherwise.

12. Returns, Exchanges and Refunds

12.1 Returns, exchanges and refunds for made-to-order or production-linked Products are governed by this Policy together with our Returns & Exchanges Policy and Warranty, Defects & Claims Policy.

12.2 Except where required by applicable law or expressly permitted by us in writing, made-to-order, specially sourced, allocation-based, personalized or limited-run Products are not returnable and not exchangeable on the basis of change of mind, subjective preference, delayed interest, mistaken assumptions or minor non-material variation.

12.3 If a made-to-order or production-linked Product is materially defective, materially incomplete, materially different from what was ordered or otherwise affected by a qualifying issue, the matter will be assessed in accordance with applicable law and the policies referred to above.

13. Digital Releases and Early Access Arrangements

13.1 Where a made-to-order or production-linked Product involves staged digital release, early access, delayed access, timed rollout, release windows or controlled access periods, those arrangements may also be governed by our Early Access Policy or by product-specific access terms.

13.2 Release timing for digital or hybrid products may depend on development completion, rights clearance, technical readiness, platform readiness, quality review or other operational factors.

14. Consumer Rights

14.1 Nothing in this Policy excludes, limits or waives any non-excludable right or remedy available to a consumer under applicable law.

14.2 Where mandatory consumer protection law applies, this Policy must be read subject to those rights and remedies.

15. Changes to This Policy

15.1 We may amend, revise, replace or update this Made-to-Order Policy from time to time by publishing the updated version on the Website.

15.2 The version in force at the time of your Order will generally apply to that Order unless a revised version is required by law or expressly stated to apply otherwise.

16. Language

16.1 If this Made-to-Order Policy is translated into another language, the English version shall prevail to the extent permitted by law unless another language version is expressly stated to govern.
